4. Free User Disclaimer – No Liability

If you use the Service without paying for a subscription or license ("Free User"):

  • You assume all risk associated with your use.
  • To the maximum extent permitted by applicable law, the Service Provider shall have no liability of any kind, whether in contract, tort, or otherwise, for any direct, indirect, incidental, consequential, or special damages arising from your use or inability to use the Service.
  • This includes, but is not limited to, errors, omissions, interruptions, delays, bugs, malware, data loss, downtime, or other defects.

5. Paid User Disclaimer – No Liability for Errors or Issues

If you use the Service under a paid plan or subscription ("Paid User"):

  • No warranty is given that the Service will be error-free, uninterrupted, secure, or meet your requirements.
  • To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any damages, losses, or costs — including direct, indirect, incidental, consequential, or punitive damages — arising from errors, malfunctions, inaccuracies, bugs, downtime, security breaches, or any other issues.
  • Payment for the Service does not imply any assumption of liability beyond what is expressly stated in these Terms.

6. Limitation of Liability (Universal)

Nothing in these Terms shall exclude or limit liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any matter where liability cannot be excluded or limited under applicable law

In all other cases, and to the fullest extent permitted by law, the Service Provider's total liability to you for any claim arising from or related to the Service shall be limited to:

  • For Paid Users: the total amount paid in the 12 months preceding the claim
  • For Free Users: €0 (or the lowest amount permitted by law)

7. Indemnification

You agree to indemnify and hold harmless the Service Provider, its affiliates, officers, employees, and contractors from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

8. Modifications to the Service and Terms

We may update, change, or discontinue the Service at any time without notice, where legally permitted.

We may also update these Terms by posting a revised version, which will take effect immediately or on the date specified, in accordance with applicable law.

9. Governing Law

  • For EU consumer residents: These Terms will be governed by the laws of your country of residence.

If you have already used the subscription to access paid features — including, but not limited to, generating a branded app, initiating a paid build, or making use of other paid-only functionalities — the service will be deemed fully performed and you will no longer be eligible for a refund.

Refund Policy

At yappo.dev, we aim to ensure you are satisfied with your experience. This Refund Policy explains when you may be eligible for a refund for paid subscriptions or services.

1. General Policy (Global)

All purchases are final and non-refundable once the paid features have been accessed or used.

  • Paid features include (but are not limited to) generating a branded app, initiating a paid build, exporting native app files, publishing to app stores, or accessing other subscription-only tools and services.
  • If you have not used any paid features and request a refund within the eligible period, we may process a refund at our sole discretion.
  • We do not offer refunds for partial subscription periods or unused time.

2. EU Consumer Rights

If you are a consumer located in the European Union, United Kingdom, or other jurisdictions with similar laws:

  • You have the legal right to withdraw from your purchase within 14 days of the date of subscription without giving any reason, unless you have expressly agreed to immediate performance of the service and acknowledged that this waives your right of withdrawal.
  • If you have already used the subscription to access paid features — including, but not limited to, generating a branded app, initiating a paid build, or using other paid-only functionalities — the service will be considered fully performed and you will no longer be eligible for a refund.
  • To exercise your withdrawal right, you must inform us in writing before the 14-day period expires (see Section 5 for contact details).

3. Refunds for Technical Issues

If you experience a technical issue that prevents you from accessing the Service and the problem is confirmed to be on our side:

  • You must contact us within 7 days of the issue.
  • We will attempt to resolve the problem first. If we cannot resolve it within a reasonable time, we may issue a refund or credit at our discretion.
  • Refunds will not be granted for issues caused by user error, incompatible devices, or third-party services.
